1. Express Agreement by Use of Website

By accessing or using any part of the website you agree and consent to be bound by these Terms of Use, our Privacy Policy, and if you use any particular service such as our Paperback Store, you do so conditioned upon your acceptance to any additional Terms of use that are applicable to that service.  If you do not agree to all the conditions in the Terms of Use, you may not access the website or use any services. 

If these Terms of Use are considered an offer, acceptance is expressly limited to these Terms of Use. Any offer for any product or service made on this website is void WHERE prohibited.

The headings used in the Terms of Use are included for convenience only and will not limit or otherwise affect these Terms of Use. 

These Terms of Use apply to all users of the site, including, but not limited to, browsers, merchants, and/or content creators.

We reserve the right to update, change, or replace any part of these Terms of Use by posting it on the website without notice to you and it is your responsibility to check this page periodically for changes. Your continued use of the website after the posted changes to the Terms of Use is deemed to be a consent and agreement to be bound by the changes.

2. Online Store Terms

By agreeing to these Terms of Use, you represent that you are at least the age of majority as deemed by laws in your area of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our product for any illegal or unauthorized purposes nor may you, in the use of the service, violate any laws that govern your residence.

3. Change to Service and Prices

We reserve the right, without notice, at any time to modify or discontinue the Product (or any part or content thereof).  Prices for our products are subject to change without notice and we shall not be liable to you or to any third-party for the price change or Product modification, suspension or discontinuance. 

4. Paperback Store

Except as expressly set out in any Terms and Conditions that apply to our Paperback Store (which apply only in relation to that service through Stripe), all warranties, representations, terms, conditions and undertaking, whether implied by statute, common law, custom, trade usage, course of dealing or otherwise (including any implied warranty, representation, term, conditions or undertaking of satisfactory quality or fitness for a particular purpose) are excluded to the fullest extent allowed by law.

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. By using the website, you agree that in no circumstance will you be entitled to liability for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement cost, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. 

For state or jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law. 

Nothing in these Terms of Use affects your statutory rights as a consumer.

5. Third Party Links

Certain products or services may be available exclusively online through the website’s third party links. We have made every effort to display as accurately as possible images of our products that appear on the Third Party Link, so we do not guarantee the content images’ color will accurately be displayed on your computer devices.

Third-party links on the website may direct you to third-party websites that are not affiliated with us. Before engaging in the transaction, please read carefully the third-party’s policies and practices and make sure you understand them. 

Contract you enter into with those third party and any use of their website are matters between you and them, so we are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or other transaction made with the third-party website. Complaints, claims, concerns, or questions about the products on the third-party link should be directed to the third-party.

6(a): The failure of us to exercise or enforce any right or provision of these Terms of Use by delay, neglect or forbearance will be deemed to not be a waiver nor will it prejudice any of our rights.

6(b): In the event any provision of these Terms of Use is determined to be unlawful, void or unenforceable, such provision shall not affect the remainder of these Terms of Use and will continue in full force and effect.

6(c): These Terms of Use are governed and constructed in accordance with laws of Massachusetts, United States.

6(d): No addition to or modification of any provision of these Terms of Use that you propose will be binding on us unless made in writing and signed by our respective representatives who are authorized to do so.
